Terms of Service
These Terms of Service (“Terms”) govern your use of GameStat, a mobile application operated by 2Seam Labs LLC (“2Seam Labs,” “we,” “us,” or “our”). By creating an account or using GameStat, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use GameStat.
1. Description of Service
GameStat is a live-scoring application for amateur baseball. Coaches and scorekeepers record games; fans and team members follow teams and view scores, play-by-play, and statistics. We may offer both a free tier and paid subscription features, and we may change, add, or discontinue features from time to time.
2. Eligibility
To create a GameStat account, you must be at least 13 years old, and at least the minimum age required to hold the Google, Facebook, or Apple account you use to sign in. By creating an account, you represent that you meet this requirement. GameStat is intended for use by adults involved in amateur baseball — coaches, scorekeepers, team staff, parents, and fans. Children do not create accounts; player records describing minors are created by adult team staff, as described in Section 5 and in our Privacy Policy.
3. Accounts and Account Security
You sign in to GameStat using Google, Facebook, or Apple. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use GameStat for any unlawful purpose or in violation of any applicable law or regulation.
- Enter information you are not authorized to provide, or that is false, misleading, or infringing.
- Harass, threaten, abuse, or impersonate any person, or misrepresent your affiliation with a person or organization.
- Attempt to access accounts, data, or systems you are not authorized to access, or interfere with or disrupt the service.
- Use automated means to scrape, harvest, or collect data or otherwise access the service, except as expressly permitted.
- Reverse engineer, decompile, or attempt to derive the source code of the app, except to the extent permitted by law.
We may investigate and take appropriate action, including suspending or terminating accounts, for any violation of these Terms.
5. Information You Provide About Others (Players)
GameStat lets coaches, scorekeepers, and team staff create and manage team rosters and record games. This means you may enter information about other people, including players who are minors, such as their name, jersey number, fielding position, and game statistics.
If you enter information about another person, you represent and warrant that:
- you are authorized to provide that information to us — for example, as a coach, scorekeeper, or team administrator acting on behalf of a team, club, or league; and
- you have obtained all consents required by law to provide that information and to allow it to be used, displayed, and shared through GameStat as described in these Terms and our Privacy Policy, including, where the person is a minor, any consent required from that minor’s parent or legal guardian.
You are responsible for the accuracy of the information you enter about others and for ensuring you have the authority and consent to enter it. If you cannot make these representations for a given individual, do not enter their information.
If a parent, guardian, or authorized person asks us to review or remove a player’s information, we may do so in accordance with our Privacy Policy, and you agree to cooperate with such requests.
6. User Content and License
You retain ownership of the content you submit, such as team names, rosters, logos, and game data (“Your Content”). You grant 2Seam Labs a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use Your Content as necessary to operate and provide the service, including displaying it to other users who follow or participate in a team. You are responsible for having the rights necessary to submit Your Content, and we may remove content that violates these Terms or the rights of others.
7. Subscriptions and Billing
GameStat offers optional paid subscriptions, which may include monthly and yearly plans, that unlock premium features. Subscriptions are sold and billed through the Apple App Store or Google Play, depending on your device. When you purchase a subscription:
- Your subscription is billed through your Apple or Google account, subject to that store’s terms.
- Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
- You can manage or cancel your subscription in your Apple App Store or Google Play account settings. We do not process cancellations directly and cannot issue refunds for store-billed purchases; refunds are handled by Apple or Google under their policies.
- Prices and available plans may change; we will provide notice of price changes as required by the applicable app store and by law.
- Any free or promotional trial converts to a paid subscription at the end of the trial unless you cancel before it ends.
8. Intellectual Property
GameStat, including the app, its software, branding, and design, is owned by 2Seam Labs and protected by intellectual-property laws. Except for Your Content and the rights expressly granted in these Terms, we grant you no rights in the service or its content.
9. Disclaimers
GameStat is provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that scores, statistics, or other data entered by users are accurate, or that the service will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, 2Seam Labs and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of data, arising out of or relating to your use of GameStat. Our total liability for any claim relating to the service will not exceed the amount you paid us, if any, in the twelve months before the claim arose.
11. Indemnification
You agree to indemnify and hold harmless 2Seam Labs and its owners, employees, and agents from any claim, loss, or liability arising out of your use of GameStat, your violation of these Terms, or your submission of information about others without proper authority or consent.
12. Termination
You may stop using GameStat and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnification.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Last updated” date above. Your continued use of GameStat after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
Informal resolution first. Before starting an arbitration or court proceeding, you agree to contact us at support@2seamlabs.com and give us at least 30 days to try to resolve the dispute informally.
Binding arbitration. Except as set out below, you and 2Seam Labs agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of GameStat will be resolved by final and binding arbitration, administered by a nationally recognized arbitration provider under its consumer arbitration rules, rather than in court. The arbitration may be conducted in Harris County, Texas, or, at your election, by telephone, videoconference, or written submissions. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.
Class-action waiver. You and 2Seam Labs agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of class or representative proceeding.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court to protect its intellectual-property rights. Nothing in this Section waives any right that cannot be waived under applicable law.
How to opt out. You may opt out of the arbitration and class-action-waiver terms in this Section within 30 days of first accepting these Terms by emailing support@2seamlabs.com with your name and a statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.
15. Privacy
Your use of GameStat is also governed by our Privacy Policy, available at https://2seamlabs.com/privacy.
